Owen's Story
Owen suffered serious leg injuries in a motorcycle accident in December 2006. Liability was vehemently disputed throughout. It was alleged that Owen entered cross hatched road markings to overtake a vehicle turning left into a petrol station. Owen denied this saying that he only entered the cross hatched markings in an attempt to avoid colliding with the defendant’s vehicle which was emerging from the petrol station intending to turn right, across his path. Just prior to trial, the defendants put forward an offer on liability of 60/40 in their client’s favour. This was rejected and the matter proceeded to a liability only trial where Owen won outright without any finding of contributory negligence. The defendants appealed, repeating their offer of 60/40 in their client’s favour. This again was rejected. The Court of Appeal dismissed the defendant’s appeal and Owen achieved 100% of his compensation which settled shortly afterwards for a little over £300,000.
